I have a query,kindly comment/Suggest.
Case 1.For how many days a daily wage earner is entiteled to be paid if he works for 25 days in a month.
Case 2.For how many days a daily wage earner/monthly wage earner is entiteled to be paid if he works for 27 days in a month
Will he be paid for 25 days 27 days respectively or a standard is there to be paid for 26 days.
Kindly quote the act or give refernces if possible.

Every company have one weekly off, we have to pay them for each working day, that may be 26 or 27 days as per the working days available in that perticuler month, but they are also liable to get the Holiday payment as declare by company.

U r right, it should be calculated as per 26 days.
He will get 25/26*Gross salary if he works 25 days
He will get paid 26 days if he works for 27 days
Depending on the month he will get more or less if he works for 27 days
Consider the case of feb. u will get a clear idea

In case of daily rated workmen he will not be paid wages for weekly offs in the month however he will be paid wages for holidays as declared by the company. In case of monthly rated workmen he will be paid for all days in a month. say 28,29,30 or 31.
Please keep in mind that while calculating daily wages monthly salary is divided by 26 days. Hence the difference.... Jagadish Kamath.

Please find below mentioned ways for paying wages:
a)Daily wages earner will get the wages of number of days he/she worked(the payment of wages should not be less than minimum wages of daily earner,incase you would not find mininum wages for daily earner or state not specified for daily wages then you can divide monthly wages by 26 days because for daily wages earner "No work .No pay" if you feel that the wages earner is working continuosly in your industry(ex: more than 30 days or there is interval due to festival on continuous working )then he/she should get wages against holidays too.
b) The standard working days for monthly is 26(in most of the case excluding weekly off),you can divide the monthly wages by standard 26 or by number of days in a month(Ex: montlhy wage of Mr. Ramesh is 3000/month and he has worked for 15 days in March 2009(only working days consider),then you can calculate his wages by standard 26 method,he will get Rs. 1730/76 for 15 days working,if you are calculating by 31 then he will get Rs.1451.61 for 15 days working+290.32=1741.93(becuase in this case we are including three weekly off too).
c)In february,you can divide monthly wages by standard 26 or 28 or 29(its depends on company policy).
In all above cases the calculation should not be less than the minimum wages of daily earner or should be equivalent or higher than daily wages earner for monthly earner.
All the above calculations accepted by Labour law.

You would be cleared everything through seniors answers,It is fair according to rules and regulations. But By this process employees don't get fair benefit of monthly offs.
So To be given fair benefit to employee in my company I talk to my boss and agreed him to calculate the salary of such type employee on the base of 30 days and I supervised what is giving . It is less much expense than to calculate on 26 days. But by this process employee will get fair benefit,
So Being a HR Professional Its our duty to given Fair benefit of Employees.

If a employee had worked for 27 days in Nov, you divide his salary of Rs.3000 with 26 days to arrive at single day salary and multiply with 27 day for his Nov. salary. By doing so he will get 3115.00 for Nov month.
By above principle, in some months the employer would get wages for 27 days and for some months for 26 days and for the month of Feb, he would get 24 and in leap year for 25 days.
