I am working in a reputed pharma company as Medical representative for the last 20 years. recently company has not given annual increament whereas it has been given to other colleagues in the same head quarter, they are not replying to my letters, mails etc. Where to give this issue?

Dear friend,
Do you have "Policy on Performance Appraisal" well in place? If yes, is it implemented consistently and uniformly?
When your performance appraisal was conducted last? Who conducted it? What is the rating process? Are the ratings kept secret? To whom you have sent your letters? Did you route your letters through your immediate Regional Manager (RM) or Zonal Manager?
Please provide more details of your case. If you have not approached HR, then approach HR and find out what they say. Try approaching Head HR at last.

Annual increments in any company will be given to the employees basing on their individual contribution for that particular financial year. Did your company, has linked up increment policy with performance of sales / marketing dept staff or not? If not so, some other reason might be there in your case. Either it may be disciplinary point of view or else your immediate boss may be given wrong feeding about your performance / behavior to higher authorities. It is a common practice in any private organisations. Hence, to know for reasons not giving you annual increment, you should meet HR dept first so that they will inform you about the facts. Accordingly, you can decide to continue in the job or else search for another job

Naturally it's a cause for worry, especially after 20 yrs.of long innings with your firm. We have no information as to what methodology normally adopted by your firm for granting annual increment. Except in some of the Firms which have such a policy to do 'performance appraisal' individually in order to consider annual increment, an "average and above performer" could be granted an increment in a normal course. And so far you were given the increment but this year it happened so should give you worries, understandable. Judge/ask yourself whether your performance has been above normal or wanting. Recollect, Was there any instance or occasion which would have rendered as a cause to with hold your increment?. Why you didn't ask/discuss with your functional head or immediate boss about it so far. Probably they should know the exact reason. As others suggested you should ask the HR also the reason behind this delay (I would call it so). Nothing is lost, approach them and ascertain why this has happened to you and you will realize what you should know there after. Don't panic but if at all anything/any area is there for you should improve don't hesitate to apologize and seek their pardon and assure them so that you would win back their confidence. I hope everything will fall in place. All the best.

hi,
it is not mandate to give annual increments.
you can only demand and escalate the issue to the seniors.
you can not take any legal action / approach any authorities.
if your salary is reduced then you can visit the respective labour officer.

It is unfair to say that "it is not mandate to give annual increments", if there is a policy and process is implemented wherein the employee has been rated good for his/her contribution to the company during appraisal, he/she should get the annual increment, and an employee can fight legally for his/her right. It would be bias to with hold any increment for whatsoever reason if rated good during appraisal

Even HR is not responding to my several reminders on this issue. However I have filed a case in the labour court as not only this they have transferred me to a distant h.q. in the name of buisness exigency. All over India they have made around 50-55 transfers all of seniors. How to overcome as per law? Please do not suggest for change.

First of all sorry for the harsh words if any, the company does not works on any employees whims and fancies that you should understand. If there is a business exigency and if your appointment letter/standing orders/ Employee Handbook/Policies states that the employees can be transferred and for which you have accepted so you cannot deny it. If you are not willing to work as per the company policies, it is advisable to look for other job which suits you instead of complaining. Once again I am very sorry to use such harsh words, but try to understand that the company cannot run successfully until and unless the employees support the policy decision taken by the management. This type of attitude must have compelled the management rating you below average and have stopped the annual increment.

With reference to query of the original queriest, it may be informed that since he is a Medical Representative, he is governed by Sales Promotion Employees(Conditions of Service) Act, 1976. Under section 6(2) of the Act the provisions of Industrial Disputes Act, 1947 are applicable to them. Grant of increment is not at discretion of employer. It is a property earned annually by employee and it can be denied only on grounds of misconduct proved against the employee. Further discriminatory treatment given to such an employee is treated to be unfair labour practice under ID Act. If they have transferred you to distant place, validity of that needs to be looked into.
