Hi All, I am working for a KPO Industry as HR Manager. Our company wanted to make it mandatory to get vaccinated for all employees and they wanted HR to issue letter to every individual asking them to get vaccinated on a compulsory basis. Is it right to issue a letter on mandatory vaccination for employees?

Please clarify, will there be any legal complications possible with this?

Dear Sindhu,

It's good to note that your company wishes that each employee is vaccinated. Nevertheless, before issuing a diktat on vaccination, I recommend having an ear to the ground. Your post gives a semblance as if the COVID-19 vaccines are available as easily as Vicks Vaporub or a Paracetamol tablet.

The situation at the ground level is completely different. The vaccines are not available at all. Those who register on the Cowin, which is part of the Aarogya Setu App, don't get the time slot. For those who get the time slot, there is no guarantee of stock availability at the local Public Health Centre (PHC). There are cases where Aarogya Setu shows vaccine availability, but practically it is not available at all.

Against this backdrop, issuing an order for compulsory vaccination will be unwanted coercion. Nevertheless, your company may have a tie-up with a local hospital and arrange the vaccine drive for the employees and their families. Many companies are doing so. Yes, you can issue a strict order for 100% attendance for the vaccination.
