Dear Seniors
The Madras High Court issued order that if an employee completed 4 years and 240 days, he is become eligible to claim gratuity w.r.t Mettur Beardsell Ltd., Madras v. Regional Lab. Commissioner (Appellate Authority under Payment of Gratuity Act), Madras etc., 1998 (3) LLN 414.
The Act says, "employee has actually worked" while calculating 240 days.
I need clarification on the following while calculating the number of days (240) :-
1) Sundays or weekly off days to be included
2) National and Festival holidays are to be considered
3) Sanctioned Earned Leave days to be considered
