Hi, An employee joined our organisation with probation contract, with terms of one month notice period in case of leaving the company during probation. In case one month notice period is not possible the employee would pay one month salary to the company. The employee stopped attending office once the one month salary was in the account of the employee. Can we take any action as a company for recovery of the notice pay?
Dear Seniors also suggest how we can avoid such situation in future.

What do you mean by probation Contract? Please send letter to address furnished by Employee stating that he has not reported for duty without prior permission or sanction of leave by Regd post Ack Due.You are concluding that Employee has left your Job on your own, which is not correct.First learn to intimate Employee in writing about unauthorized absence & build up record.

Sir,
We had already sent a letter by speed post (kept on record the delivery details received from tracking) asking to report or at least call the general manager, but still there is no communication from the employee.
Please advise what action the company can take when there is no communication from the employee for more than three weeks.

Congratulation for sending letter directing him to report for work.Further, for the sake of record you have preserved proof of delivery of your Letter.Even after 3 Months Employee has not reported for duty nor sent any communication.Now for the sake of record, Remove Employee name from your Rolls with prospective Date(Future Date) Reason for leaving-Voluntary abandonment of Service.In EPF ECR Mention Date of leaving------- & Reason C Cessation.
Please prepare Full & Final Settlement & recover any amount due to Company.In case of any Pre Employment verification, inform prospective Employers that Employee in question Abandoned your Service without any intimation
