Please clarify whether a member's family with the below period of employment is eligible for Edli benefit.

A Member employed with establishment A from 09.10.2017 to 30.04.2021 (30.4.21 is a Friday). He had PF contributions for the entire period in this establishment.
Joins another establishment B on 04.05.2021 (Tuesday) - 1st and 2nd May are National and weekly holidays.
After 10 days he is confirmed Covid positive, admitted in hospital and breathes his last on 25.05.2021
Will his family be considered eligible for Edli benefits as per notification issued in April 2021? Will his employment in establishment A be considered for full EDLI benefits? As there is three days gap between two employments will it restrain the family from EDLI benefits?

In Establishment B, his gross salary was Rs.40,550/- and Epf was payable on Rs.15000/-. His family received Rs.27829/- towards salary for 21 days.

The employee is considered under "No pension" category and hence family will not receive any pension benefits as well.

Kindly clarify.

Death claim was submitted in July 2021.

Because of other administrative reasons like - Pension contributions were made though he was not eligible for pension, previous contributions were not transferred.

Now after merging pension contributions with Epf and transfer of previous contributions, death claim was settled.

Citing a gap of three days in the employment between the two establishments of the deceased, only Rs.56123/- was given towards EDLI to the family.

Anyone please clarify why as per circular of 2023 (Efile no: 53464 dated 03.02.2023), the employment of last twelve months immediately preceding the month in which the employee died should not be considered for EDLI benefit?

If the family deserves full EDLI benefit, also advise, how to take up the issue.
