Dear Sir, I have a query related to gratuity. 240 Days consider as working days or calendar days. In case of working days weekly off (Saturday, Sunday ) will be included or not.

Dear Harish,

It would have been better had you gone through Sec.2-A of the PG Act, 1972 and analyzed it before raising the query. Continuous Service for the purpose of Gratuity as defined under the above section includes days actually worked, holidays of all sorts, authorized leave, unauthorized leave not declared as break in service, legal strike, lock out, lay off etc.

In the given case, the employee has completed a total service of 4 years, 10 months and 10 days. Hence he is eligible for gratuity as per the provisions of Sec.2-A mentioned above.
