I am an employee of a company for the past six years, you have resigned from my company and served the notice period. However my company head does not want me to leave and delay every process even work handover and now the notice period is completed, he is still telling me that I didn't complete the project and didn't do proper handover. At the same time companies, and the legal team threatened to file a case against me and will demand all the money given to me because it is investors' money and what projects I have done is not worthy enough and acceptable to them. They are also blaming to founder/CEO for this. I don't know whether this is a game against me to retain me. Please advise that in which case the company can file this kind of case against an employee.

Dear AK Singh,

You have written how your manager is not allowing you to quit the employment though your notice period is over. However, from whatever you have written, it appears that your manager is not satisfied in two counts. One is quality of the work and second one is completeness of the work.

After submitting the registration, you and your manager could have sat and decided for what you will be responsible till your last working day. The lack of clarity has put you in the problem.

While leaving a company, it is important for you to leave on a smooth note. Therefore, have a meeting with him and understand from him what are his expectations. At the same time, provide him with a proof of your work done during the notice period.

If the satisfactory outcome does not emerge from the meeting, then escalate the matter to the MD. In your application, write clearly for what were your deliverables and how you have met them.

Try to reconcile with the situation. Please keep it in mind that employers always enjoy a whip hand.

Thanks for the reply. My current company is an startup and companies ceo is my direct boss as he is the head of research team. I have even worked one more month after last working day of notice period and completed all the project after his oral confirmation about completion of work. I left office and he told me that he will clear the two months pending salary and will give all documents related to releaving. He also assigned all my projects to one employee of company and told me to help him to understand the project.
But I calling and mailing several times he is telling me that there are still some improvements needed in the project which was not known at that time. Now he is saying to me to come to office for few weeks and resolve all the problems
I refused to come and asked what is the guarantee that he will clear all dues and give necessary documents if I will do all correction to project according to his requirements.

It looks like this is a last attempt to somehow extract more work from you. The talk of unsatisfactory work and incomplete work is only to exert pressure on you. The fact that there has been no adverse communication till the notice period is over and thereafter all this talk clearly indicates that it is an afterthought. You need not worry unduly about the threatened legal process. Any reasonably good advocate will be able to defend you properly.
In case your original testimonials are with them, they may not issue them and your relieving order so easily. You may have to follow up with them for some time. If everything fails you may also threaten legal proceedings in the matter and submit an application to the Labour Officer of your area for intervention and help.
