Hi, In our company they part the salary only in & we didn’t deduct PF & ESIC at any level of salary ranges from 5000 to 18000 per month to employee. will it harm us in HR terms???

It is illegal. So do not worry convey this to Directors / Owners otherwise also they have to answer government authorities for this.......

All statutory bodies will initiate inspection to all type of industry and the penalty will be levied with damages and interest. If the said amount is not in papers or in you balance sheet, its well and good but if everything is showned, you have to be ready to pay the excess amount along with a fine/interest. Better inform your Management and try to get help of an consultant and work out something which would help your management to face any shortfall during inspection. It would be a great learning for you too. But always as an HR , you have to ensure that all benefits for your workmen are given under any circumstances.

First you confirm whether your establiment/organisation covered under PF/ESI
Secondly, if not covered these, then how many employees arre there in your organisation
Third one, if your organisation fulfills the above conditions, you cn not avoid.PF/ESI is a mandatory one
