You may strictly follow the procedure of your company and shall be in line with the
separation clause mentioned in the appointment letter issued to him, during the period of
probation. Principle of natural justice shall be applied.

Hello Rahul,

Your Appointment letter may have a standard term that Company can terminate an employee on probation period with or without notice. However, unless and until the reason is very strong (like fraud, misconduct etc.) companies do follow a system of giving notice of 15 days or so to the respective person. This will make sure he's getting paid till the time he works in the company.

If performance is the reason of termination, you may extend the probation by next 3 months.

Termination of service during the probation period is subject to the prescribed notice period. So, the employee is entitled to such payment as per the probation clause if the termination is without notice unless there is no notice period during probation. Pl. check the probation clause.

Normally companies appt. letters provide for lesser notice period during probation period. Check relevant clause in your appt. letter and accordingly you will have to pay the salary amount.
