If any women employee avails the Maternity leave as per the act. If she is not physically present at the workplace then can she apply for monthly earned leave as per the Factory act.

The period of maternity leave (with wages) will be considered as days worked for getting eligibility for earned leave in the subsequent year. But she will not earn leaves on these days. That is, for eligibility an employee needs to work for 240 days in a year. This shall include maternity leave days. An employee having qualified to get earned leave will EARN leave on the basis of one day for every twenty days PHYSICALLY worked. For that only days physically worked (excluding days spent on maternity leave) will be considered. In short, she will get earned leave but the number of leave will be less.

The woman employee can take her earned leaves already exist in her account, if the availing Maternity leave required on exigency.
The employee need to apply her balance leave in support of documents to extend the leave.

The query lacks clarity. Why should the employee take Earned Leave if she is already on Maternity Leave?

In many occasions, either of the mother or new born baby develop health issues after delivery. Therefore the mother needs more days of leave beyond the quota of maternity leave till gets good health to resume her duty. Where such requirements exist the employees would take the leave from her balanced EL in her account than go LOP. This has reference to the question of Mr. P. Venu.
