Dear sir,
Am working at one consultancy from past 2 years, from Sep-16 to March-17 I has received my bonus amount on Oct-17.
Now am going to quit my current company, I asked my bonus amount with my manager he said ifyou left service "we will not pay you the bonus."
In our CTC they showed Bonus as 8.33% on Basic on our Appointment Letter.
So what I can do for further I should get a bonus from April-17 to till now
Request you to help me to get my bonus amount

Dear Shilpa,
Sec.8 of the Payment of Bonus Act,1965 entitles every employee who has worked for a minimum of 30 working days in an accounting year to bonus under the Act for that year. It automatically implies that it is not necessary that one should remain in the employment of the establishment when bonus is declared or paid. Barring the disqualification of dismissal on account of fraud or riotous or violent behaviour or theft, misappropriation or sabotage of the properties of the establishment as mentioned in sec.9 of the Act, any other type of termination of the services of the employee can not render him ineligible for bonus later had he worked for the minimum of 30 working days in a year. Therefore, your management's view is wrong.
You first resign and then demand bonus. If they refuse, make a claim u/s 21 of the PB Act,1965.
