Contact your insurance agent/company for claim of the damages as per terms & conditions of insurance policy. As far as your driver is concerned if in your preliminary investigation it is found that this accident had happened due to his negligence then you can take action against him by suspending him. In the alternative pay him full wages for the period of absence as he is not at fault.

Just saw your comment over here..please do let me know your view in my father's case and if you do not mind thn will call you and brief you about it.
My father coming from Office to Home on 20th Dec 2010 and near to my home he met with an accident with Bus and Died on the spot due to the Brain Hambrage. My father was driving the Motor Cycle and he was wearing Helmet too in-spite of this tragedy happed and he was retired from Indian Air Force and getting pension and working with Pvt Organisation.
Now please guide me what step should we take against Bus Owner because this accident happed due to the Bus driver negligence.
Help me out and I will call you after getting reply from your end.
