As per interpretation of supreme court, Factory act not apply when factory building/ plant is under construction, Factory act only apply when manufacturing process started till then BOCW Act apply and employer has to obtain registration under BOCW act for under construction building/ plabt/ factroy and has to pay 1% of building / plant/ factory construction cost towards BOCW cess .
