In short your question is about the continuation of a pending collective industrial dispute raised on behalf of a group of workmen under the Industrial Disputes Act, 1947 in respect of a workman who dies during its pendency.
Whether it is a collective dispute or an individual dispute, the death of a workman after its institution vests the right to continue the dispute in his legal heirs. What they have to do is to get them impleaded in the pending dispute. In case the award or the judgment of the case favors the claim of the deceased workman, only the monetary compensation if any arising out of the final orders becomes payable to the impleaded legal heir of the deceased workman.
