Dear Seniors, Our company is based in India and we are hiring one employee in Kenya and we do not have any physical office there. Since this is the first overseas recruitment in our company, I am not aware of overseas recruitment-related rules and regulations.

Kindly guide me on what rules and regulations we need to follow in such recruitment. Can you please share any format of the offer letter and appointment letter for the overseas recruitments?

Check with the local embassy or consulate as to what is necessary for you to operate there as a company or business. I am assuming you are recruiting him to work in Kenya and not have him come to india for work.

1. Do you need an office there (or to register as a branch)
2. How can you pay him without violating their ForEx Laws (also check with your own banker what rules you need to follow to remit money to him for salary and expenses)
3. Is there any agreement between india and Kenya for PF or similar retrial benefit and how do you ensure he gets the same.
4. What is your liability as a foreign employer in case your employee in Kenya does something wrong / illegal
