Then he is not eligible to have gratuity from the employer. For getting more information on the point plz go through section 4 of the Payment of Gratuity act, 1972.

Dear Kosh,
An employee should have rendered continuous service in one organization for at least 5 years to become eligible for Gratuity payment. Your employee has rendered a service of 1 year 7 months. Hence he is not eligible for the Gratuity payment.
An employee is entitled to get gratuity even before complication of 5 years service provided (the employee should have become permanently disabled. in case of death his family will receive the gratuity amount) that the employer is tied up with the LIC and should have contributed to the gratuity amount monthly. The actual amount and the interest accrued therein will be given to the employee.
The Gratuity amount is paid only after the separation of the employee from the organization or after superannuation of the employment.

Any employee who works for at least 240 days in a calendar year for each of 5 years and more of his service period and fulfils the requirement of Sec.4 of the Payment of Gratuity Act, is eligible for the payment of gratuity to him, whether he is daily rated or monthly rated.
