Hi everyone, I’m new to this community and please do help me for my query. What is the penalty one is liable in the wages act on non-compliance?

Hi piyush,
As i don't know for which act you are asking for, i will consider the penalties for both the acts.
Penalties incurred to Minimum wages act
Payment less than the applicable wages:
Imprisonment up to 6 months or Rs. 500 or both
Contravention of the Act:
Fine up to Rs. 500
Penalties incurred to payment of wages act
Contravention of the act, Non-production of Documents and/or Obstruction to perform Duty:
Fine from Rs.200 up to Rs.300

Continuous Offence:

Imprisonment from one month to six months and fine from Rs. 500 to Rs. 3000

contravention of payment of wages act, mainly on deductions and failure to pay on time, penalty would be Rs. 7500 per incident. Now I am not sure whether the penalty is per worker or for all of them taken together.

The penalty is minimum Rs 1500/- maximum Rs 7500/- imprisonment for minimum one month and maximum six months depending up on the violation .Pl read Sec 20 of the POW Act. Varghese Mathew 09961266966

Dear Mr.Piyush,

Any violations of Payment of Wages Act , the penal clause is depend upon the quantum of violations which shall be imposed by the Court of Law, where the case is filed by the Enforcing authorities in the jurisdiction. If non compliance of POW act totally avoided, shall be more as specified our learned member Mr.Varghese Sir. If partially compliance, then quantum of penalty may be less but this will be with warning. Repetition of the same or any violations specified in the lAct shall be dealt with seriously. Hence it is our advise better to comply with the applicable acts to avoid penal clause as now a days there are so many infrastructures are available on the computer and if the quantum of work is more then you can apply for exemption for maintenance of records in case similar to the other acts. When we were in service in the seventies and eighties, we were doing all by manually irrespective any strength including payroll.but now all the facilities and relaxations in the applicable laws are allowed.

Dear Piyush,
Your query relates to a few very basic ingredients of Labour Laws. I think you should read atleast the Bare Acts of related subject to have an overall view of the matters you would have queries. Queries on certain debatable issues, or those requires detailed clarifications or to be disseminated w.r.t. judgments passed by various courts are always welcome by which we also keep learning and get updated. During the last 2-3 days your purpose would have been served had you spent a few hundred rupees for buying Bare Acts which will be always handy. Sir, if a unskilled Labor is working with a unskilled minimum wages , After one or two years this unskilled labor has a skilled ability , and after that why he is not getting skilled rate for daily wages. Similarly if a skilled labor working for more that one or two years , obviously he gets some high skilled with them after some experience, so why he is not getting a rate of wages of High skilled rate. Please suggest is their any rule in our PF Dept or any where. Please suggest me.

Need suggestions on many Indian companies don't pay minimum wages as per wages act to own employees, but they shows increase salary on Their salary books because to safe himself for future inspection and companies make fools innocent employees and they can't avail EPF benefits. How can we aware people/employees etc.about this discrimination
