I worked in a resort from 01/11/2015 to 17/09/2020. 2 months back, HR staff told me to resign. Appealed to HR Manager, he threatened I would suffer if not resigned. Then told me to go for a deputation when my town is announced containment zone. No transportation. Again they informed me to go for a deputation. Requested to give in writing. They also gave in writing but there is no end date of deputation service only reporting date 07/09/2020.

In the deputed place, superiors started to harass the next day onward. Without giving me the tools and staff asked to do the works. Different leaders of the same department came hard on me by giving tons of work that they can't themselves do. I wrote an email to the HR, Resort Manager and others informing the worst condition of the place before I carried out the works. Then again they dealt very badly on writing this email. In the next email, informed corporate HR about physical, mental, and emotional torture by superiors. I took photos of the area and some documents that show that for the last few months not cleaned and maintained records.

I sought the help of a union secretary over there. He brought his neta, he told that tonight all the angry union staff whose jobs are in danger will attack you. Surrounded by union staff and HR staff and department managers compelled and forcefully made me write the resignation on paper and email. The leader snatched up the phone and modified the resignation letter and sent it to corporate officials. The union leaders and other company union staff themselves dropped me nearby home at night.

I informed in writing the company corporate officials that it was under life-threatening situation and fear of saving my life made me to write and even some portions written by HR staff. Corporate officials are silent, no replies from any leaders.

Hereafter, they won't allow me to work in the hospitality sector. Near about fifty thousand, they want me to pay including Gratuity, Leaves, and 1-month salary.

Can anyone help me, I need a just compensation for abruptly ending the service. Now I am jobless, homeless, and hopeless.

"Pre-planned Termination Of Employee With Help Of Outsiders"??

I have a few questions for you, and your answers can help community to understand your query and situation with more clarity before replying to you.

1) Do you have any animosity with someone in the workplace you've worked on?

2) Why do you think it was a pre-planned termination and on what ground you are saying like this?

3) You have not shared the reason for asking to resign from your employer, what was that?

4) Are you the only employee who was asked to resign and later mistreated by them, like the way you described in your query?

As per the information that you have shared here, it demands immediate action and filing a complaint to the local police station if you have gone through such a situation and when you know that the situation now has become life-threatening for you.

So, you must not look for the suggestion to get your compensation/ dues only. As it seems to me is not just a sort of conflict between employee and employer or anyhow related to TERMINATION only. You must take the help of police without wasting time Mr. Benjamin.

It is very difficult to believe that this is happening in Kerala, Union conniving with management to ease out a long serving employee, deny all due benefits and threatening physical violence. Since you have immediately retracted the resignation and mentioned use of force, such a resignation is not legal and proper, it cannot be acted upon.
You can file complaint with the Labour Inspector and raise dispute about illegal termination of service. You may file a police complaint stating apprehension about violence and naming the suspects. The copy may be marked to the District Administration (Collector & SP) as well as local media

Answers
1. Only my department HOD. And HR Manager & my HOD are long time friends, worked in different places together.
2. May be in June 2020, HOD informed that the whole department considered under.
-performers, so all will be terminated including him. So he told me to be prepared to face the situation, he also can work upto next month. After 2 days, HR staff asked me to resign because of the under-performance. I replied, "I can't resign, you yourself terminate." Then they told me to go for a deputation to Kollam, the HR Manager also denied paying me advance. He don't say clearly how many days or months or years. Only upon reaching the spot, the deputation duration can be decided said HR Manager. Immediately called my So I wrote an email informing to Resort Manager that My father is paralyzed and my wife is epilepsy patient. Again insisted me to go for deputation at Munnar in writing. I was warned that if didn't go, the management will take strict action.
3. They said Under performance (over phone not in writing).
4. Some staff from Tamil Nadu also who are in Fixed Term Contract from my department have been terminated ( one staff are in his 3rd year, 1st year and some completed of 1 year)
3 days back HR Manager called me to collect full & final settlement. In the document, other than monetary settlement, some condition saying that I myself resigned, no case or approach public forum against company etc., no claims are remaining. Where i need to sign it is like this "Agreed and Accepted unconditionally" under this statement my name is printed. HR Manager is also a criminal lawyer. So, I told him give a copy of it, so that i can get advice from expert and came without signing. They didn't gave a copy of it. This document was from the company's letter pad.
The same day evening called me and informed, he had another simplified version of this document. This document is in plain paper, it is clear that I myself wrote this letter. Uploaded this document.
I am living in a rented room. Financially drained. Nowhere to go. I am afraid to go against the Union because it has its presence everywhere villages and towns and cities. I always thank God for the protection when they dropped nearby house. My family members all prayed the reason is the Union neta and some members are bringing in their own car to drop me.
So I don't know what to do. Can anyone help me, whom should i approach.
