Hi, Greetings!!!! I have joined a BPO two months ago. There is a lot of stress and workload here, and I am working 13 to 14 hours daily. Everyone here is on contract. If I want to leave this job, I need to give a one-month notice period or deposit one month's salary. Is there any clause in the Bombay Shops and Establishment Act for contract employees? For example, requiring one month's salary or a one-month notice period within the first two months. Is there a probation period? Please help.

Hi, Notice period doesn’t differ on Permanent & Contract employees. It depends on organization’s HR policies. You should check your appointment letter for the same.

Hi Mili,
Thank you for your message. In the appointment letter, it states that there is a one-month notice period. I would like to confirm if the notice period of two months is also applicable or not. Additionally, there is no mention of probation, clause, or section in the appointment letter.
Your prompt clarification on this matter would be greatly appreciated.
Many thanks,
Mili

First of all, you are eligible for compensatory time off for overtime worked or can claim overtime as deemed fit. Working 13 to 14 hours is only acceptable if that does not harm your health. An employer who does not care for their employees is selfish and must be stopped. If I were their HR manager, they would beg for mercy for their atrocities on employees because an employer who only cares about making money and not sharing it with employees is criminal.

Dear Mili,
Under the Punjab Shop Act, 1958, notice by the employee is to be given after three months of service. Please refer to the Bombay Shop Act. An appointment letter does not exempt one from the law. Kindly contact the area Labour/Shop Inspector regarding this issue.

Pl. help me all seniors. I don't want to work again for one month. I can't work for 14 hours with only 5 to 10 minutes of break. Due to a slowdown for the past 2 months, I am working here. Being a well-qualified person, why should I suffer? In the appointment letter, there is no clause, no section mentioned. They can't include anything in the appointment letter. Would like to appreciate your great support. What is there in the Bombay Shops and Establishment Act? Help.
Many Thanks, Mili
