Hi, I would like to know what the purpose of Form 11 is. I came across a few posts on this but could not gather a definite conclusion.
Currently, only those employees whose basic is less than 6500 are covered under PF in my organization. Does Form 11 need to be filled by existing employees whose basic is more than 6500 also, irrespective of whether they had PF in their previous organizations or not?
If yes, then does signing Form 11 mean that the employee is giving a declaration that their basic is above 6500 and they voluntarily do not want to opt for PF?

It is a declaration by a person taking up employment in an establishment in which the Employees' Provident Fund and Family Pension Fund Scheme are in force.
It doesn't mean he can opt out of PF. As I said earlier, it is a simple declaration made by the employee about his previous employment (that he was a member of PF or not).
See, if he has a salary more than 6500 there, he will remain a member of PF with your organization if he hasn't withdrawn his PF.

Once a person is enrolled under the PF Scheme, irrespective of his salary increments in consecutive jobs, he does not have an option of exemption from the scheme unless the company is not registered under the statute.
On the other hand, if a fresher joins his first organization with Basic + DA above Rs. 6500/-, he can opt out of the PF scheme. However, he has the option to join the PF Scheme in his future organizations.

My company is covered under both PF & ESIC. I am recruiting engineers as Trainees, and for at least 6 months, they will be under probation. During this 6-month period, I do not want them to be covered under PF or ESIC. Is it possible? The issue is that most of the time the candidate vanishes after a few days or a month, rendering all the procedures done a waste. How can this be managed effectively?

Welcome to this query! I too was initially in the dark regarding this provision. However, I have now acquired the exact solution.
The trainees you are referring to are under the purview of Certified Standing Order or Model Standing Order for the class of Apprentice. The payment you are providing them shall be considered as a stipend and not wages. Therefore, you can exclude them from PF and ESIC. I strongly recommend that you certify your standing order and include all these provisions for the apprentices, such as their stipend, training period, safety, leave, etc.
