Can you please let me know the number of leaves in a calendar year the employees are entitled to? I am working in a private software company based in Pune (5-day week). The leaves are not bifurcated into CL, PL, and SL in our company. The leave policy is a total of 15 leaves in a calendar year (including Public Holidays), i.e., 3 working weeks. I would like to please see inputs from your end.

Hi Swetha, Even I would agree with Chetan.........It is at the sole discretion of the management to fix the no of leaves. I guess the max no would be 24 in a year.

The employee is entitled to 18 EL (1.5 leaves per month), 12 GL (1 per month), and declared holidays (as per state Govt.). In the industry standard, declared holidays range from 10-13 holidays, which include Gandhi Jayanthi, Independence Day, and Republic Day.

It may vary from the commercial act that applies to your organization and your state. If you are in Haryana, the mandatory number of leaves are as follows: CL - 7, SL - 7, PL - 15 for the whole year. It may depend on the internal leave policy of the company whether these leaves would be carried forward to the next year or not. In most organizations, only PL gets carried forward to the next calendar year, but CL and SL lapse on 1st January.

Different companies have different manuals depending upon their Manning System, and hence, the best person to inform you about the same would be your HR Manager/Executive. For example, in my organization, an employee is entitled to 35 annual leaves, and Trainees are entitled to 24 annual leaves.

You can look into the Shop and Establishment Act of your State. The said Act of West Bengal prescribes:
1. 14 days PL on full pay for every completed year of service.
2. 14 days sick leave on half pay against a medical certificate.
3. 10 days CL on full pay.
4. In the case of women, Maternity Leave in addition to the above.
However, in our company, we also have 15 days leave (CL in nature) in addition to the 12 calendar holidays.

It all depends on the company policy. Every organization has its individual norms. If you consider our organization, we have one set of leave policy:
- CL: 12 days
- SL: 12 days
- EL: 12 days
Altogether, there are 36 days of leave for the calendar year.

Number of leaves differ from one company to another. It completely depends on your company policy and how you are going to design it. However, I can suggest something basic - overall, leaves should total 34, including holidays. The breakdown is as follows: 12 Holidays, 12 PL (Paid Leave), 5 CL (Casual Leave), and 5 SL (Sick Leave). This is the common practice followed by most software companies, including my own.

As per the Factory Act, one leave for every 20 working days' presence subject to a minimum presence of 240 days in a year.
As per the Shops & Est. Act, a minimum 21 days leave in a year subject to a minimum presence of 240 days in a year.

Your company comes under the Shops and Other Establishment Act. You can go through the Shops and Other Establishment Act applicable in Maharashtra. In general, 15 days of earned leave are given after completing one year of service. Sick leave is 7 days and can be accumulated up to 35 days. Earned leave accumulation generally depends on the management as they are encashed at the time of relieving. In strict terms, the maximum accumulation can be for 60 days. However, the management is normally flexible regarding the accumulation of earned leaves and they do not put any cap on it. Casual leave entitlement is 12 days for a calendar year and they are not carried forward.
