Dear All,

Please note that holidays are a schedule item under The Industrial Employment Standing Orders Act 1946 (please see the Schedule, Item No. 2). A Model Standing Order will contain this provision. This should be taken as a clarification to Mr. Siva's observation that Standing Orders have nothing to do with the holidays.

Please note that state/industry practices may differ. Some may provide the minimum/more, but holidays are a Standing Orders item.

Please advise me if an employee is absent for 20 days in a month and a National Holiday such as 26th Jan, 15th Aug, or 2nd Oct falls in between. Is he/she entitled to the holiday?

There was mention about Factories Act in one of these replies for National and Festival Holidays. Please note that Industries and establishments are covered only under The National and Festival Holidays Act, and no other Act has any jurisdiction on this subject, including Standing orders.

Industrial Employment Standing Orders were enacted earlier to the National and Festival Holidays Act, and hence there was a mention in the schedule. It was not deleted. It is well settled in law that the legislation enacted later will have an overriding effect on the clauses mentioned in earlier legislations if they were not specifically repealed. Hence, I reiterate that one needs to refer only to the National and Festival Holidays Act for any clarification on the number of days.

There were references that we can have 12 days, etc. in some replies. We can have any number of days. There is no ceiling. But we are talking here about the minimum number of days allowed under the law.

This again varies from State to State. As I said, it varies from 9 to 12. Tamil Nadu has 9, Karnataka has 10, Kerala has 12, Delhi has 9. You need to refer to the local act for this.

No one seems to have observed my posting on Holiday for the General Election. I am raising this subject now because while planning for Holidays for next year, we must plan one more extra day. Manufacturing people should note this as they will start screaming when the holiday is declared. Please plan for one extra holiday for the year 2009 for the general election.

By which Act in Delhi is the minimum number of holidays for the service sector 9? Can anyone comment? I think it's only 3 as per the Shops & Establishments Act. The National Festival and Holidays Rules (Punjab) are applicable to Delhi only for establishments under the Factory Act.
