In my opinion first we are to see which of the enactment is applicable in your case regarding the grant of compensatory off. If your unit unit is covered under Factories Act, 1948 then you are go through provision relating to grant of comp off under this Act or otherwise if your unit is covered under S&E Act then go through you applicable state S&E Act. In our case in Haryana state we do not find any provision relating to grant of Comp. Off under S&E Act & if we take work from employees on this day then we are to give OT to the concerned employees.Therefore, first examine which of the Act is applicable to you & the adhere to that Act for this purpose.
