I suffer from a medical condition that results in seizures. My doctor has expressly advised against living alone under any conditions. Hence, I am unable to relocate to my original site in Bangalore. I am seeking an internal team transfer or site transfer to Noida. There is a team in Noida that performs work related to my skillset. As Noida is close to my home, I will be able to stay under the care and supervision of my parents, which is beneficial for my health. However, my current manager in Bangalore is not understanding my situation. He has given me an ultimatum - either come to the office or submit my resignation. This is putting me under immense mental strain and I am unsure of how to proceed. Can anyone provide guidance on this matter? Is it legal for them to force me to resign due to my inability to relocate to Bangalore due to medical reasons?

I'm sorry to hear about your situation. It's important to know that as per the Indian Disability Act, 2016, discrimination against an employee on the grounds of disability is illegal. This includes forcing an employee to resign due to medical conditions. Here's what you can do:
1. Document your situation: Keep a record of all communication with your manager regarding your medical condition and your inability to relocate. This could serve as evidence if the situation escalates.
2. Consult HR: Approach your HR department with your issue. Explain your situation, provide medical documentation, and express your willingness to work from the Noida location.
3. Legal consultation: If your HR department doesn't provide a satisfactory solution, you may want to consult with a labor law attorney. They can provide advice based on your specific situation and may be able to guide you on the next steps.
4. Seek support from colleagues: If there are others in your organization who are aware of your situation, their support can be beneficial. They can vouch for your work ethic and your commitment to your job.
Remember, it's crucial to maintain open and honest communication with your HR department throughout this process. They are there to support you and should be able to help you find a solution that accommodates your health needs while allowing you to continue contributing to the company.

Dear Virat,
You suffer from seizures, abdisease of neurological disorder.
You requested your management for a transfer to your native place on ground of the doctor's advised.
Your company did not agree to your request.
1. In my opinion you continue in Bangalore, if wants to continue the job.
2. The other option is to resign prior to any action by the employer termination of service.
3. The seizure sickness considered as medicaly unfit for job related to brain storming and electro-magnetic environment.
4. You search for new job matching your skill at Noida but don't highlight the sickness for negetive impact on your job search.

Hi Prabhat,
I am dealing with a seizure condition, which I am currently managing with medication. I can comfortably work from my home location as I can be under supervision. However, if I were to relocate to Bangalore, I would be on my own, which could lead to potential difficulties if I were to experience a seizure.
With this in mind, is it within my rights to request an internal transfer to my home location?

Dear Virat,
Does your company HR not awre of rights available to an employee?
Why do you request, while relocation is your right under the employment?
I know, any suggestion which are not aligned with your wish will not be accepted to you. This is a general psychology of human and feel it strongly.
In this matter would like to keep two examples to calm your mind :
1. My wife is under neuro disorder from 2020 all of a sudden and consulted the best doctors and hospitals of the country, no improvement till date. A single dosage of injection cost 35 K and only valid for 60 days and gradually potency came down to 30 days hardly. This injection is the only treatment available in this world. The injection has it's negative works on body besides other treatments.
2. A week back a young man residing next to door got his 1st attack of seizure, now he is admitted in Apollo Hospital. The doctor advice the boy to stay away from computer radiation environment at for an year.
Do not lose heart, HR can't help you unless your boss agrees. You talk to your boss and convince him. The disease you are suffering from having better treatment at NIMHANS, Bangalore and a formidable weather conditions than your home place. Ask your family to stand by your side, if don't get relocated.
There is no such rights available to one unless fight in court.
Wish you speedy recovery.
