We are a private limited company with around 200 employees, some of whom have retired after attaining 58 years of service. Due to an outside agency audit, some of the employees need to sign in with their old designation.

My first question is whether they can use their old designation even after their retirement. If yes, then PF and other welfare commitments apply. We have hired them again but as retainership on fixed monthly remuneration. However, the external agency has not accepted this type of retainership arrangement.

If your company has a policy for providing an extension of service after superannuation, consider giving a two-year extension for continuity of service. Create a policy for extending senior management cadre personnel on a case-by-case basis to meet business needs. This approach will address all your problems. Implement the policy with retrospective effect, possibly starting from March 2023 onwards.
