Hello Dear Senior Partners,

I would like to know if ESIC is applicable for employees who are over the age of 21 and have a gross salary under 21K. I request your suggestions on this matter, and your input will be highly appreciated.

I think by overaged employees, you mean employees aged more than 58 or 60. For coverage of ESI, age is not a factor, and as long as his earnings are within the threshold limit of Rs 21,000, he should be covered.

As per the provisions of the PF Act, the employer may not be able to contribute to employees' contributions after attaining the age of 58 years. I think it may not be possible beyond the age of 58 years unless the employer obtains written approval from the Director of ESIC.

Under both EPF and ESI, contribution is not restricted by age, and you can continue contributing to EPF and ESI even when the employee's age crosses 58. In the case of EPF, the employer's contribution towards the Pension Fund shall be diverted towards EPF with a 12% contribution to it, as opposed to 8.33% to the Pension Fund and the remaining 3.67% to EPF.
