Navigating Resignation Delays and Notice Periods: An Employees Dilemma - CiteHR

I have resigned from my present company as I have received a better opportunity. However, my Branch Manager is delaying the acceptance of my resignation because it is the month of March. If he accepts the resignation so late, even on the last working day, will I have to serve another 1-month notice period? If that happens, I won't be able to join my next company where my joining date is 10th April. In my present company, my last working day is 4th April. Kindly help and guide me.

Sir, I have already tried it, and from my side, I don't want to stay after my last working day. If my present company accepts the resignation on my last working day, will I have to submit another 1-month notice period, or will it be auto-approved, allowing me to leave?

Hi, In the normal course, the notice period is to be served from the resignation letter date only. However, there is a possibility that your company might state the notice period starts from the acceptance date. In that case, make a humble representation to your superior to resolve the issue amicably.

The notice period starts from the day following the date of submission of the resignation letter. Accordingly, submit a fresh letter stating the last working day as per the notice period agreed and ask for being relieved on that day. The acceptance of resignation could be any date, but you are not expected to serve a day more than the notice period.

However, the HR department is ignoring the situation and instructing me to coordinate with my Branch Head and Regional Head. My Branch Manager is unnecessarily delaying the process and stating that he will not accept the resignation until the end of the month.

    Will the resignation be automatically approved on my last working day, sir? Are there any rules regarding this situation?
