Dear Members,

Since we have continuous festival holidays, I need clarification for October 3, 2022.

We are off on the 1st, the 2nd is a public holiday, and the 3rd is a working day followed by the 4th and 5th for pooja holidays.

Do employees who take leave on October 3rd fall under a sandwich policy where it should be counted as 5 days (starting from the 1st till the 5th)?

Thank you.

Best regards,

For 31 days in a month, the employee went on leave from Monday to Saturday for a continuous 6 days and rejoined on the following Monday. There are 5 Sundays in that month. How should we handle payment for Sundays? The total working days for that month are 20. Should the total paid days be 20 working days + 4 Sundays = 24 paid days, or 20 working days and 5 Sundays = 25 paid days?

Hi, it depends on the leave policy of the organization. If casual leave is taken on the 3rd and the employee reports for duty on the next working day, then only the 3rd will be considered as leave.

Under the current regulations, you cannot mark the employee on leave for 5 days. The sandwich rule applies to leaves taken BOTH BEFORE AND AFTER a public holiday or rest day.

In this case, he has not taken leave before and after the leave day, so you cannot deduct salary for those days. This is probably in the model standing orders or your certified standing orders.
