Imparting education cannot be equated with any industrial or economic activity, and as such, a teacher cannot be considered a workman even though education is seen as an industry in current judicial thinking. Therefore, teachers employed in unaided private schools will not fall under the purview of the Minimum Wages Act, 1948. However, the service conditions, including the salary, of those teachers working in State Government-aided Private Schools can be regulated by the States through appropriate legislation.
