One contractor failed to pay ESIC and PF contribution from the last 2 months. Should he inform PF and ESIC office for nonpayment of contribution?

The PF & ESI contribution becomes due and payable when wages are paid. If wages are paid to the workmen without remitting the due contribution, it is a serious offense as well. Informing the respective offices is not going to help in any way in whittling down the offense.

In continuation, I would like to add that as principal employer you would have to remit the entire contribution with interest and recover it from the concerned contractor.

At the earliest, impress upon the contractor to comply with ESIC and PF regulations, including any applicable penalties or interest. If the contractor fails to comply, as the Principal Employer, you should take the necessary steps to ensure compliance.
