During the probation period, you asked the employee to leave the job within two months. Now, you wish to maintain your records showing that the concerned employee was hired by you as a consultant for two months. You need to obtain an invoice from the said employee for the professional services rendered by him, and his payment is to be settled against this invoice. If the employee falls under the Income Tax bracket, then the applicable TDS is to be deducted from his payment, and you should issue him Form 16A.
This advice is provided to you because the aforementioned employee worked with you for only two months, and you need to avoid listing his name on your muster roll for various reasons.

Have you issued any letter to the person before they joined your employment? If an appointment letter was not provided to the said employee, then where do the terms of probation come from? Why do you want to consider the person under 'Consultancy'? How can you do that in the absence of the document and the person to sign the agreement? Have you paid the person during the period of engagement or created any ID under EPF and ESI? If all these are absent, kindly ask the person to pay for their services and have them provide a self-declaration stating that their turnover is less than 20 lakh.
