We have an MSME unit employing 30 workers. We typically work 12-hour shifts, including 4 hours of overtime. Please advise on how we can make payments for overtime wages without violating any rules under the Factories Act. Our normal 8-hour payment ranges from Rs 350 to Rs 750 per 8-hour shift.

Factories Act

Under Sec. 59, it is mentioned that where a worker works in a factory for more than 9 hours in any day or for more than 48 hours in any week, he/she shall, in respect of overtime work, be entitled to receive wages at the rate of twice his/her ordinary rate of wages. Section 65 of the Factories Act may be referred to. The maximum overtime in a quarter is 115 hours.
