Dear Sir,

Kindly suggest -

As I approached many times, the company told me that they have paid the LIC premium for the last 2 years, and the company cannot raise funds right now as they are in a financial crisis. They mentioned that you have until June 2020. We will do something. Earlier, they asked me to wait until October 2019.

What should I do? Kindly advise.

I apologize for asking multiple times, but the situations keep changing.

Hi Rashmi,

I have already advised on this. Tie up with LIC Group Gratuity Scheme, and late commencement of LIC Group Gratuity scheme can't be presented as a reason for late payment of Gratuity. Whether the employer pays Gratuity directly or through LIC Group Gratuity Scheme is the employer's choice, but Gratuity has to be cleared within 30 days from the date of receipt of the request application for Gratuity.

It's better you file a case with the Assistant Commissioner of Labour immediately and submit all relevant documents to him. The employer cannot unreasonably evade by asking for more time before the Controlling Authority. Please don't delay further.
