Liabilities as per Employee Compensation Act (amendment of WC Act in 2009).
If the employee is covered under ESI and the organization, and the employee followed the rules specified in the Shops or Factories Act, ESI Corporation will take care.
If not covered in ESI but the employer has covered employees under Group Accident Insurance, Medical Claim kind of policies, based on the scope of coverage, insurance companies will take care.
