Dear Professionals,

I just want to know if someone's gross salary increases more than Rs. 21,000, then the employee is bound to continue as a member of ESIC. For example, if there is an increase in salary of more than Rs. 21,000 during the contribution period, the membership status will not change. However, if an employee crosses the given limit before or after the contribution period, they will no longer be a member of ESIC.

Is it possible for an employee to choose to opt-in or continue ESIC membership once their gross wages increase beyond Rs. 21,000? Please share if there are any government orders regarding the same.

if the employee and employer both are agreed to pay contribution, there is no bar to continue, but the wages benefit will be under ceiling of 21000/- pm for benefits
