My query is about the withdrawal of PF of a deceased employee. I am working as an HR Executive and I need your suggestions in this particular case. An employee "A" was working in our organization until 10th July 2017. Unfortunately, she passed away on 17th July 2017 due to a road accident. I would like to know the procedures for how her family can withdraw her PF and who the nominee is for the PF withdrawal, considering she was married.
Her mother has informed us in writing not to process the PF for her husband as he has displayed inappropriate behavior and is an alcoholic. Therefore, please confirm who the nominee should be for the withdrawal of the PF amount in this case.

Please confirm who is the nominee mentioned in her PF records. If, on paper, it's her husband, then the organization is liable to pay that amount to the nominated person. No letter or email will be void in front of the declaration provided by the employee. We and the law will only go by papers, irrespective of all verdicts provided offline.
The employer has to keep all required ID proofs and declarations from the employee's nominee for future reference.

You have confirmed that the deceased woman employee was married as per your records. Consequently, the husband is the nominee for receiving EPF contributions. For EPS pension, the husband and children below 25 years are eligible. For EDLI (only applicable for death while in service), the husband is eligible.
It has been almost 5 months since the date of death. Please use the Composite Death Claim Form #20, 10D, and 5IF available on the site.
