The employee in question is eligible for claiming maternity benefits under the Maternity Benefit Act, 1961. It appears that when she joined your employment, she was in an advanced stage of pregnancy. It is also presumed that she is not covered under ESI.

As per MB act women Must actually work for 80 days in 12 months immediately preceding her date of Delivery. Thus in above case lady is entitled for the benefits under amendment of MB act 2017.

If a newly joined female employee covered under ESI has remitted 123 days of contributions but has not remitted the contributions for 9 months, she may not be eligible to receive benefits under ESIC.
