Hi, I am Vasu, an MBA (HR) and LLB graduate. Earlier, I was an HR Manager. Now, I am practicing in the legal field.
I need to serve a legal notice on behalf of an employee to his former employer, which promised some gifts to that employee if he met a specified target. He was successful in meeting his targets; all his other colleagues were given gifts as per the norms (written/mail communication between the employer and the employee) except him. Eventually, he left that organization by serving his notice period. All his dues were cleared by the company except gifts (worth Rs. 1 Lakh). Regarding this, there were some email exchanges in which he communicated with the HR department. Please suggest whether he will receive his gifts. Tomorrow is the deadline, and I would appreciate your prompt response on the matter.

As your post is from Pune, I am considering that you are interested in getting the definition of a worker and non-worker from the MLWF Act. Please refer to the Maharashtra Labour Welfare Fund Act for the definition of a worker/employee. The worker/employee who is not covered under this definition shall be considered a non-worker.
