I worked for a company for one year. Now, I was serving my notice period. They fired me yesterday by saying that I misbehaved with HR because I gave my point of view to the HR regarding the issue of why to come on Saturday, which is officially off when I have no projects and am stuck. She found it offensive. Because of this, she fired me, claiming I misbehaved with her and refused the assigned duties. Now, they are not giving me the experience letter or documents. Can anyone tell me if this is legal or what I need to do?

Hi,

In legal terms, the employer issues a termination letter if it's a forced exit. In your case, only the termination letter can be issued, which is not a positive sign for your career. In the future, if you wish to showcase your experience at this company, it's better to end on a good note and try to obtain a relieving letter instead of another one.

To do so, it's better to speak to your boss or a senior authority for the same. Propose to them to accept your resignation letter and issue a relieving letter to you. Secondly, ensure that they provide positive feedback to your next employer.

If you don't want to do this, then avoid mentioning this experience in your resume. It will help you settle into your next job.

Hi,

Documents (related to educational or professional certificates) come under "personal asset." Not giving of "personal asset" to the person to whom it belongs is defined as "abduction." So, log a written complaint at the police station about the abduction of your personal asset. Take a copy to HR and retrieve your valuable documents. If she denies, ask the police to take action.

Regarding the experience letter, I think Neelima's suggestion is good that you don't need to mention it in your next updated resume.
