Hi,

Is it legal for a private life insurance company to force their employees (sales staff) to resign because they are not pleased with their performance and make them leave immediately? Afterwards, all of those employees received emails from the HR department of their ex-employer, stating that they have to pay compensation for the notice period not served as defined in their appointment letter.

I was one of them and I had to resign in 2011. Neither have I received any relieving letter from them to date, nor the Full and Final settlement.

When I replied to their email, they just stopped communicating.

Most of my batch-mates (whom I met while joining) have gone through a similar experience, and for those who were working with that specific channel, they departed with a violent experience, including explicit verbal abuse; it was a normal phenomenon.

Can a public limited company continue with such bad HR practices?

Would appreciate comments and suggestions from senior HR personnel and individuals familiar with corporate law.

I would like to thank citehr for giving me an opportunity to share this experience.

Dear Upalray,

Your resignation was taken forcibly in 2011. But then why is the company raising this issue now? When did you receive notice for the payment of the notice period? When you submitted the resignation, why did you not take proper clearance and acquire a "No Due Certificate"?

Secondly, if the resignation was taken forcibly from a couple of employees, then why did none of you show unity and send a lawyer's notice to the employer?

I find a disconnect in your post. Please provide complete information in chronological order.

Actually, I think the management of that company is sadistic because they have given a derogatory comment in my employee background verification through CRP check. I have just lost a very good job opportunity because of that on 14th January 2015 😞, and that was the topic in my first posting on this site. Create fake account on twitter and facebook and bombard them with fake ids. Take revenge as a customer

Create an account on Mouthshut, ConsumerCourt, and other review sites. Leave negative reviews criticizing their policies. Claim that you have been cheated and mention that they do not compensate customers in the event of a natural death. Aim to damage their business by making them spend millions on online reputation management to address the negative feedback from customers who feel their money has been stolen.

To state, after four years, that you were forced to resign does not work in your favor. However, at the same time, being asked by HR to provide a notice period amount after three years is barred by limitation and not recoverable by him in any case.
