Dear all,
I need your help to understand the following:
I've been terminated without citing any reason, and I've sued in City Civil Court. I've requested reinstatement. Now the matter is, how can I withdraw my PF? In the last 2 months, no contributions have been made as per the current PF update statement. So, what should I do now? Wait until judgment is released?
If I opt for a full withdrawal, under what reason should I state? If I mention termination, it means I'm accepting termination, and resignation is not applicable.
What will happen to my PF account if I wait until judgment? The case was filed on 8th April 2014.

The city civil court cannot order your reinstatement.Hence without waiting for the judgement you can withdraw PF. Varghese Mathew 09961266966

Dear Mr. Mathew,
Thank you for the advice. In such a case, it will be proven that I have accepted the termination, for which I have sued to term it as unlawful and illegal termination. The company will take advantage when I fill up the form for final PF withdrawal. Could you please advise if such a withdrawal will impact the case?

No the withdrawal will not impact the case .But if you do not withdraw the amount of PF will earn interest for a maximum period of 36 months. Varghese Mathew 09961266966
