Yes, an employer can pay a higher salary to anyone in the same job based on performance. However, if discrimination based on gender or race is proven, then you can seek a remedy. In India, discrimination based on gender alone is now illegal.

I second Raman, 'Merit Pay' works on the principles of delivery and not on the term served during the employment. The payment structure is discussed with the employee before they take up the employment. Hence, it's concurrent with the benefits and rewards they were looking for. Similarly, performance standards and ratings are shared right at the beginning of the financial year. This leaves no room for conflicts.
