Hi, I just wanted to know that within how many days after leaving a company one can apply for the PF? and if the company is not doing anything what we can do from our end?

Dear Member,

After completing 3 months from the date of leaving the organization, if the company does not proceed with your form, you should go to the PF office and ask to provide the Right to Information form for just Rs. 20 or Rs. 30. Fill it out and submit it to the PF office. You will receive a reply from the PF Commissioner within seven days, and your problem will be resolved.

Dear Rizkabbas09@gmail.com,

Answer to your first question:

You have a two-month waiting period. This means that only after the completion of two months from your relieving date can you submit your PF withdrawal forms to your company, duly signed by you with a declaration of non-employment.

The company will, in due course, endorse the said forms and either submit them to RPFC or hand them over to you for submission from your end.

This waiting period is not applicable in the case of (i) retirement at the age of 55, (ii) women who are withdrawing it for marriage, (iii) permanent and total incapacity to work, (iv) migration from India for employment or permanent settlement abroad, and (v) mass or individual retrenchment.

Answer to your second question:

You have the following options:

1. Make a written complaint to RPFC if the company is not signing/forwarding your PF withdrawal forms.

2. Submit the forms directly to RPFC, duly attested by (i) the Manager of your Bank, or (ii) the Head of the Educational Institute, or (iii) a Gazetted Officer, or (iv) the Sub Post Master, or (v) a Magistrate, or (vi) a Member of the Central Board of Trustees (EPFO), or (vii) the Chairman, Secretary, or Member of the Municipal/District/Local Board, or (viii) the President of the Village Union or Panchayat/MP/MLA, or (ix) any other officer approved by RPFC.

Dear There is provision of 60 days waiting period for withdrawal of Provident Fund Accumulations. On completion of this period you can approach your Employer to fill up Form no 19.

Shri. R. B. Yadav Ji, Advocate,

I agree with you, Sir. There is a provision of a 60-day waiting period. In my posting, I have mentioned the waiting period of two months, which equates to 60 days. It appears that you have misunderstood this information when reading it.

Thank you.
