Our garment manufacturing unit consists of a ground floor, first floor, and a second floor. On the second floor, we have a dormitory along with a mess for lady laborers. Under the Factories Act, is it allowed to have a dormitory at the top of the factory premises? Please clarify this.

It would be advisable if you consult the respective Factories Rules of the concerned state, which give detailed information, terms, and conditions of the applicability of the Factories Act in that state. In your case, it would be the Tamil Nadu Factories Rules 1950.
Please see if there is any provision contrary to what you intend to do. In my humble opinion, it can be allowed if proper safety and safeguards for the occupants are ensured. It can function as a Guesthouse/temporary accommodation rather than a permanent place of residence for employees.

Please refer to the below Tamil Nadu Statutes Governing Factory Management under the Factories Act. Therefore, it does say that any manufacturing process which has 10 or more workers must provide sufficient latrine and urinal accommodations of prescribed types.
