Dear All,

I am working in the HR Department, dealing with PF & ESIC of our company. We all know that in the case of the death of a member, their family members receive financial benefits. I would like to know if a member receives any benefits under PF or ESIC when their dependents (such as spouse, child, or dependent parents) pass away.

If yes, I would be grateful if anybody could provide me with the clause reference.

Dear Bhagya Anant,

Please do not muddle up between the IP (insured person/member) and his dependents. As per the Labour Act under Section 81, dependents get the benefits.

Notice for dependents' benefit -

On receipt of a claim or claims for dependents' benefit in respect of the death of an insured person and after making such inquiries as may be necessary about the circumstance and cause of death and about all persons who may be entitled to dependents' benefit, the appropriate Regional Office shall issue, by registered post, to such other persons, if any, as appear on inquiry to be entitled to dependents' benefit and who have not yet submitted a claim for such benefit, a notice for the submission of claims for dependents' benefit within a period of 30 days from the date of such notice. The notice shall indicate, inter alia, the relevant provisions of the Act and regulations and the procedure for the submission of a claim for dependents' benefit.

Therefore, a copy of the Benefits in a death case by Labour Law is attached for your knowledge and comprehension.

A subcontract employee of our main contractor fell off the tractor he was driving at the construction site of our factory premises and received injuries on his forehead and elbows. His coworkers (also subcontract employees) rushed to him, splashed water on his face, and offered him water to drink. He was helped to stand up, after which he chose to walk on his own and sat on a parapet close by. His coworkers rushed him on a motorcycle to get medical help, but he succumbed to death on the way.

Does the onus of giving medical attention solely lie on the principal company or anyone on the site of the mishap?
