If we are taking casual leave before and after gazetted holidays (for example, 26th October 2011, with 27th as casual leave and 26th as a gazetted holiday), how will my leave be accounted for if I take leave on the 24th, 25th, and 28th of October 2011? Will it be considered as 1 day of casual leave or 5 days of leave?

It all depends on the policies. In my knowledge, many companies don’t encourage CL to be prefixed/suffixed with Holidays. Pon

Many companies follow the concept of sandwich leaves wherein, if there is a weekly off or a gazetted holiday between two of your CL/SL, then the holiday/off is also counted as leave. Please seek clarification from your HRD before applying for leaves.

As per labor laws, an employee is entitled to 7 days of casual leave in a year on a pro-rata basis. If he/she has a balance of CLs, then these can be prefixed or suffixed.

Understanding Leave Policies for Holidays Between Leaves

As per common practice, any holiday (such as Sundays or National Holidays) that falls between two leaves (EL, CL, or SL) will be considered as leave and deducted from your leave balance. However, it is not mandatory to be considered this way. If your company prefers to treat holidays between two leaves as holidays themselves and not deduct them from the leave balance, it can do so. This decision varies based on your company and its policies. It is advisable to review your company's leave policy for any clarifications.

If CL is taken on friday and monday (sat sun being leave) then it is counted as 2 days holidays only , and 2 are weekends..

It all depends upon the policy of your organization. In a government organization, any casual leave prefixed and suffixed with Sunday or a holiday shall be treated as casual leave only. For example, if the 26th of October, 2011 is a holiday and you want to take casual leave for the 24th, 25th, 27th, and 28th, your absence will be regularized as casual leave.

In general, casual leaves are on a pro-rata basis and sanctioned for no more than three days. The intervening holidays and weekly offs are considered part of the leave. In the present scenario, either two casual leaves on the 24th or 25th, or the 27th and 28th, can be taken.

In the case of Earned Leave or PL, the intervening holidays/weekly offs cannot be considered part of the leave.

Additionally, as per your service rules/leave policy, in some organizations, there is no bifurcation of leaves. Instead, a lump sum amount of leaves will be credited to the employee, and the employee can use them in any way.

Leave Combination Rules

Only Earned Leave can be combined with any other leave and can also be prefixed or suffixed with holidays or week-offs. However, intervening holidays will be treated as Earned Leave. If you take Casual Leave (CL), it will be considered as continuous 5 days of leave.

One of our employees has applied for half pay leave for the period 31/07/2017 to 04/08/2017 and 7th August as RH. The employee is going abroad. 5th & 6th August is the weekend. 7th August is a restricted holiday on account of Rakhi. Under this situation, RH being suffixed after the weekend, can we ignore the weekend or should it be counted in continuation to the period already applied, i.e., half pay leave applied for the period 31/07/2017 - 04/08/2017 to be continued for 5th & 6th August, thereafter permit RH to be suffixed?
