Hi, our company divides the salary into the following pay heads: basic, DA, HRA, and others. My question is, what are the heads from which ESI is deducted from the salary structure? Is it basic, DA, and HRA, or only basic and DA? Please tell me, it is very urgent.

Suppose I received my bonus in the month of December, and that is part of my gross salary for that month. In this case, will it be taken into consideration for ESIC, or will it be excluded? Since we are not covered under ESIC, but this is just to update myself.

In the case of ESI facility for employees, is it not necessary for the employer to provide sick leave separately? I just read this on one site and am totally confused. Can anyone please explain to me how it works?

If sick leave is given as leave eligible as per the applicable law, then it should be given even if the employees are covered by ESI. The Factories Act is silent about sick leave. Therefore, if the Factories Act is applicable, sick leave need not be given to employees. In contrast, if the Shops and Commercial Establishments Act, which is a state enactment, applies, provisions regarding leave with wages may vary from state to state. Some states may have provisions for giving sick leave, such as the case of the Kerala Shops and Commercial Establishments Act. If so, sick leave should be given regardless of whether the employees covered by ESI receive leave from ESIC.
For employers, ESI leave essentially means leave without pay.

Sick leaves are given to employees as per the company's leave policy. For example, if you provide 7 sick leaves per annum, employees are granted these leaves. If the number of leaves taken exceeds 7, the exceeded leaves would be without pay, which employees can claim from ESIC by showing medical proofs. However, this is only possible if the employee has availed medical benefits from ESIS during sickness. (I am not fully certain if this information is correct or not).
