Dear Seniors,

One of my colleagues has met with a road accident while traveling from Bhubaneswar to Angul (both in Orissa) on office work. He was traveling in a hired vehicle with a commercial number (Yellow number plate). The fault lies with the driver who fled from the site of the accident.

My employee is seriously injured and is receiving treatment in ICU in Cuttack.

How can I claim compensation from the vehicle owner?

Please suggest.

Dear Santhosh,

Better lodge a complaint against the vehicle owner. In turn, he may forward the claim to the insurance company. Most of the time, the settlement will be through court in such MCOP cases; sometimes the party may agree to an out-of-court settlement. Keep all the bills and expenses listed for the claim. Consult with an advocate before proceeding.

Dear Sir,

The cost of hospitalization has exceeded Rs. 50,000. The vehicle owner is already burdened by paying the cops to release his vehicle, and more expenses will be incurred to rebuild his car. He is certainly not in a position to cover these expenses. If I file a case against the car owner, it will be a prolonged process, and the benefits will reach us in a long time.

Please advise if there is something like a motor vehicle tribunal or a similar entity. What is MCOP?
