Please find the details below. Also attaching a format of 19 & 10C:

Instructions for a member while sending application to Employees' Provident Fund Organization:

General:

1. Use the appropriate form for claiming Provident Fund Pension, withdrawal benefit/scheme certificate, Employees' Deposit Linked Insurance benefit, etc. as given below :-

• Form-19 : To claim final settlement of Provident Fund by a member.

• Form-10-C : To claim withdrawal benefit/scheme certificate under Employees' Pension Scheme '95.

2. Ensure that all columns of the application are filled completely.

3. Information in the application form relating to name, a/c no. should agree with the details

available with Employees' Provident Fund Organization; which were furnished by the employer at the time of enrolling to Provident Fund.

4. Application should be signed by the member/claimant.

5. It should be attested by the former employer. In case attestation by the former employer is not possible, it should be got attested by any other authorized official specified with application form.

6. Application for final settlement can be sent by a member on completion of 2 months from the date of leaving service, if the reason for leaving service is other than superannuation, medical ground, retrenchment and V.R.S./ Female members getting married etc.

7. Desired mode of payment can be given legibly, if the amount involved is more than Rs. 2000/-. The amount will sent by deposit in payees' bank a/c. To facilitate this, Bank a/c no., name and address of the bank should be furnished. An advance stamped receipt should also accompany this application.

8. Application may be supported by the return Form-10, showing the details of leaving service and details of contribution for the year in Form-3A, if not sent earlier by the employer. (This will be taken care by the concerned employer)

  • Thank you, Hema, for the reply. However, there are certain grounds which I want to know about. Please help me out with them:

    1) In Form 10-C, in the first serial, there are two options. The first one is "Name of the Member," and the second one is "Name of the Claimant(s)." So, we have to fill only the "Name of the Member" column and write N.A. in place of the "Name of the Claimant(s)" column (if the application is made by the employee himself). Could you please clarify whether I'm right?

    2) In Form 10-C, in the Ninth Serial (Particulars of Family), there are two options. The first one is "Family Members," and the second one is "Nominee." What do we need to fill up in those columns? Please advise.

    Hi Amit,

    Thanks for your reply.

    For the first question, fill in both columns with the names of the members.

    For the second question, write the names of the family members with their relationships, and also write the name of the nominee. The reason behind this is that if the claimant is not alive during the time of payment, the same can be given to the nominee. (Of course, there are other formalities in the event of the person's death.) It is important that this column is filled in.

    Please note your point pertaining to Form 10C of the Provident Fund Act; the name of the member is enough. Do not bother about the claimant. You are absolutely right.

    The other point is that only the nominee's name is sufficient. Do not bother about the family details. Both the above forms will be submitted to the PF office 60 days after the employee leaves the organization. Secondly, the bank details of the employee should be correctly mentioned in the form by the employee. You have to attach Form 12-A, Form 5, and Form 10 (copies when you are submitting the same). I hope the above is clear. You can also cross-check with Hema, who has been quite helpful. All the best!

    Hi Hema,

    Thanks a lot for Form 10C. I needed it, and I am in the USA; I did not know where to get it from. While searching on the internet, I stumbled upon this forum and found one.

    Could you please clarify a few points?

    a. Can a downloaded copy be used, or does it have to be a "Government" issued copy?

    b. Can I fill up and fax it to my company in India? I mean, will a faxed copy be acceptable? Sometimes they require an "original" signature.

    c. Do I have to get this form notarized?

    d. If I have to request that my brother in India sign and send this form, do I have to give him some kind of "Power Of Attorney," or how can I make it work? What is the process?

    The bottom line is that I am here in the USA, my Pension fund is with a company in India, and I want to withdraw the money and deposit it into my account in India. How can you help?

    Hi,

    I have neither withdrawn nor transferred my PF money, and my PF funds are still with my last three previous firms starting from the year 2003. Is it possible to withdraw the same or get it transferred to my new PF account with my present company?

    Regarding your queries:

    A downloaded copy can be used.

    b. Can I fill up and FAX to my company in India? Will a FAXED copy be acceptable? Sometimes they require an "Original" signature.

    You need to fill and send the original signed copy to your company. A FAXED copy is not acceptable.

    c. Do I have to get this form notarized?

    No. The company will verify the form, and the authorized signatory of the company will sign the form and affix the authorized signatory's stamp as well as the company stamp.

    d. If I have to request that my brother in India sign and send this form, do I have to give him some kind of "Power Of Attorney" or how can I make it work? What is the process?

    Your brother's signature will be of no use on the form; it has to be signed by you. The bank account mentioned should be in your name only (individual account), should be either ICICI, SBI, or PNB, and the address needs to be complete.

    Yes, you can transfer from the previous 3 companies to the current company directly. However, check with the person handling PF in your current company. You will need to fill out transfer form 13 for each account separately to transfer from the old account into the new account with your current employer.

    I have filled out Form No. 10c, Form 19, and Form 3A (revised) duly filled out by the organization. Can I know what I have to do in the next step?

    Get the duly filled form verified by the company, signed, and stamped by the authorized signatory of the company along with the company stamp at specified locations on the form. Then you can either request the company to deposit the form on your behalf or check with them the office where your PF is maintained and deposit it either in person or through registered post.

    Hi Jayant,

    You will also have to affix 2 revenue stamps on the document. I would suggest that someone in India prints the form for you, affixes the stamps, and then FedEx it to you in the US so that you can fill it and send it back. One of the reasons that most forms are rejected by the PFO is that the member (you) will have to sign across the revenue stamp. This is a procedural technicality which often gets overlooked.

    I have neither transferred nor closed my PF account in the past 7 years. Now, that the company has merged with another company, how can I claim that amount? I only have the EPF's statement of account.

    Hi,

    The ideal solution would be to have someone in India courier the document to you after affixing the revenue stamps. When you look at the form, there will be a space for affixing the revenue stamp. Once it is affixed, you will need to sign across it.

    I have recently switched over my job from the private sector to the Central government's PSU. Previously, I was employed by Airtel and Idea Cellular. Currently, my Provident Fund (PF) with both of these private companies is inactive. I am interested in withdrawing this amount. Can I withdraw this amount while being employed in another company?     Hi,

    In case your ex-employer runs a PF trust of their own per Govt. Regulations, we have no choice but to get our Form 19 & 10C to be routed through them. However, no ex-employer bothers whether their ex-employee is getting withdrawal in time or usually delays the employee's withdrawal request.

    In such a case, what should the ex-employee do? How could RPFO help such employees/members in getting their PF amount? Please guide.

    My father was a member of the PF through their organization. Due to his death, I want to know the procedure for PF. Which form do I have to submit to the PF office? He died during his service time, but his employer marked him as absent on that day. His organization does not want to acknowledge in PF that his death is job-related. What should I do?     Hello!

    I have a few questions regarding the PF form 10-C. Currently, I am living in the US with my husband. While filling out the PF forms, I provided my parents' address for postal communication. Additionally, I want to designate my father as the nominee. Is it acceptable, or should I list only my husband as the nominee, considering that I am married?

    By mistake, I entered my father's name in the column "Name of the claimant" in section 1b of form 10-C. I have learned from previous posts that this field should be left blank or filled with our own name. Should I leave it as is, or should I strike it off? I would like to know if only a Savings Bank account in any of the three banks specified here, namely ICICI/SBI/PNB, will be accepted.     Hi all,

    One of my colleagues just joined a new company. She has some queries regarding PF deduction. Her company used to deduct 12% of the basic salary for PF. Now, she wants to use Rs. 780 for each employee, irrespective of the basic salary. Is it possible or not? Is there any government rule that states the company has to maintain the same percentage for PF deduction as they previously used to?

    Hi Jayanth,

    Don't be confused when claiming the PF Amount.

    1) If you have an Indian government one rupee revenue stamp, please download Form 10C & 19.

    2) In Form 10C, on page 2, sign the following column (Signature or Left Hand Thumb Impression of the Member/Claimant(s)). Then on page 3, paste a one rupee revenue stamp and sign 50:50 on the stamp.

    3) Fill in your live savings account bank details on page 2, serial no. 11, and enclose a photocopy of your bank passbook.

    4) If you have left your last company for more than 3 years, attach your ID proof i.e., Voter ID, Driving License, or Ration card.

    5) In Form 19, on page 2, sign in two places - one with a revenue stamp and the other without a stamp.

    6) Then send the form to your previous employer with a request letter. They should fill in all the details you provided in your Nomination Form Form-2 when you joined (like your family details, birth date, and joining date).

    7) Once your past employer signs the form, they will submit it to the relevant PF Regional office.

    8) After receiving your claim form, your amount will be automatically deposited into your savings account.

    9) If you don't have a revenue stamp, ask your brother and send it by speed post.

    Hi Shilpaz,

    In Form 19 Contribution for the Current Financial Year, there is no critical detail. It is very simple. Every year, the employer submits all employees' annual contribution details along with Form 6A & 3A (for the period 1st April to 31st March). If any employee resigns from their job between the period of March to February, the employer fills out the Contribution for the Current Financial Year and certifies that. This is because the PF office does not have those details. Therefore, the employer fills out the employee's monthly PF contribution details, such as monthly earned Basic employee contribution & employer contribution details every month, like Form 3A. Okay, it's clear. Also, you fill out the form 3A along with the claim form.

Somehow, I found out my PF account number - AP/HY/59995/24. However, the Hyderabad office informed me that the establishment has only maintained accounts up to 2007-08, so they cannot verify this account number. What is the procedure to obtain my correct account number? My employee number is 136127, and my date of joining was July 16, 2008. My employer is also unwilling to provide any information.

    (1) Is this PF account number correct? If not, what would be the correct PF account number? (Employer is uncooperative)

    (2) How much balance remains in my PF account, and how much can I claim?

    (3) I have filled Form Number 19. If the employer refuses to attest it, who else can attest it? Can a gazetted officer do it?

    (4) Do I need to fill out other forms besides Form 19? If yes, which ones? Considering I am 26 years old, do I need to fill out Form 10C?

    (5) Where should I send this form - to the Noida office or Hyderabad? What is the address?

    (6) Can I send the form with the information I possess?

    Regarding your question about whether the basic salary can be less than the minimum wage, in my opinion, for EPF contribution, it should not be less than the minimum wage.

    I would like to inform you that there is a pending case in the Supreme Court between Group 4 security and the EPF department regarding the breakdown of the minimum wage (basic salary less than MW). Therefore, we need to wait for the decision for some time.

    Form 19 is for getting back the provident fund contribution, which is 12% of the employee's and employer's contribution to EPF in excess of FPF. It is the withdrawal form.

    Form 10 C is for getting back the Pension fund.
